Terms and Conditions

Eligibility: Subject to the additional restrictions below, the Faces and Places of Delaware North contest is open to all associates of Delaware North Companies, Incorporated, and its subsidiaries.

How to Enter: E-mail photos of Delaware North properties and/or associates to facesandplaces@dncinc.com between 12:01 a.m. U.S. EDT April 20, 2009, and 11:59 p.m. U.S. EDT June 30, 2009.

Upload to our FTP site photos of Delaware North properties and/or associates to ibackup.com between 12:01 a.m. U.S. EDT April 20, 2009, and 11:59 p.m. U.S. EDT June 30, 2009. The user name is facesandplaces and the password is dncinc.

Mail photos of Delaware North properties and/or associates to Delaware North Companies, Inc., Attn: Photo Contest, 40 Fountain Plaza, Buffalo, NY 14202. Entries must be post marked between 12:01 a.m. U.S. EDT April 20, 2009, and 11:59 p.m. U.S. EDT June 30, 2009.

All photos submitted must be original (film or digital) photos that typify and represent the spirit of Delaware North. Contestants can enter more than one photo. The following information must be provided with your photo: a brief identification of the subject and location of the photo, first and last name(s) of entrants, phone number, mailing and e-mail addresses. Each photo submission must be authentic, original and unaltered. Photos will not be returned. Both black-and-white and color photos will be accepted. Photos capturing the image or likeness of any celebrities, professional athletes, other public figures or any trademarks, names or logos of a product or entity (other than our own) will not be accepted. The submission must not infringe the copyright, trademark, privacy, publicity or other intellectual property rights of any person or entity. Delaware North reserves the right to disqualify any entry that is alleged to infringe on any third party’s intellectual property rights or that Delaware North, in its sole discretion, deems obscene, offensive or otherwise inappropriate for viewing by a general audience. All e-mailed photos must be in .jpg format, less than 1 MB, and will be scaled to a maximum of 600 pixels wide by 400 pixels tall.

*If your photo includes the image and/or likeness of other persons, every person in the photo must sign the attached photo release form consenting to his or her inclusion in the photo. These forms should be sent to:

Photographs lacking appropriate documentation and release forms will not be allowed for re-publication.

Winner Selection: A group of Delaware North judges will select the top 10 finalists based on the following criteria: appropriateness to theme (40%), content (30%) and creativity (30%). The top 10 finalists’ photos may be used in the Delaware North annual report, the company’s and its subsidiaries’ Web sites and other company publications or marketing materials. The judges will then select the top four winners to receive prizes. The finalists and winners will be selected on or around July 19. All judges’ decisions will be final.

Prizes: The grand prize is a digital camera. The next three winners will receive a $250 American Express gift card. 

Winner Notification: Winners will be notified on or around July 19, 2009, at the e-mail addresses and/or phone numbers they supplied when entering the contest. The judges reserve the right in their sole discretion to select an alternate winner in the event a winner cannot be reached after three attempts via phone or e-mail. 

Participation: By participating, contestants agree to be bound by these Official Rules and the decisions of the judges. The company reserves the right to disqualify any entrant who is found tampering or abusing any aspect of the contest.

Conditions:  Delaware North is not responsible for lost, late, or unintelligible entries, lost connections, miscommunications, failed transmissions, other technical difficulties or failures. Delaware North reserves the right to terminate or modify this contest at any time in the event of any intervention with the promotion beyond the control of Delaware North. In such a circumstance, finalists and top four winners will be selected based on entries received to date of termination.

Copyright: By entering the contest, each contestant grants Delaware North Companies, Inc., and its subsidiaries and affiliates a royalty-free and irrevocable right and license to publish, print, edit or otherwise use the contestant’s submitted entry and name and likeness, in whole or in part, for any purpose, both commercial and non-commercial, and in any manner or media throughout the world in perpetuity and to license others to do so, all without limitation or further compensation. Each contestant further agrees that if his/her entry is selected as a winning entry, he/she will sign any additional license or release that Delaware North requires.
