Important: Please read these Official Rules before entering the 2019 Winter GuestPath WOW-A-THON! Sweepstakes (the "Sweepstakes"). By participating in this Sweepstakes, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules.

Sweepstakes Period: The Sweepstakes begins at 12:01 a.m. United States Eastern Standard Time (“EST”) on Sunday December, 1st 2019 and ends at 11:59 p.m. EST on Tuesday December 10th 2019 (“Sweepstakes Period”).

Sponsor: The Sponsor of this Sweepstakes is Delaware North Companies, Incorporated, 250 Delaware Avenue, Buffalo, New York 14202.

Eligibility: This Sweepstakes is open to (a) current employees of Delaware North Companies, Incorporated and its subsidiaries and affiliates (collectively “Delaware North”), (b) temporary workers at a Delaware North unit who are employed by a third party agency, and (c) volunteers providing volunteer services to a Non-Profit Organization that has a contract with a Delaware North unit to operate a sales location for fundraising purposes who in all cases (i) are assigned to a Delaware North unit that participates in the GuestPath program during the Sweepstakes Period and (ii) are awarded a WOW-A-THON ticket by a supervisor or manager at the Delaware North unit in recognition of the employee’s, temporary worker’s or volunteer’s excellent customer service skills.

How to Enter:

Via Website: During the Sweepstakes Period, Delaware North employees, temporary workers and volunteers who receive a WOW-A-THON! ticket must visit the sweepstakes page at www.guestpath.com and complete the entry form. The entrant must enter his or her first and last name, email address, WOW-A-THON! ticket number and unit name, and agree to these Official Rules for an entry to be considered valid. Each entrant is allowed one entry per unique WOW-A-THON! ticket number.

All entries must meet the Entry Criteria listed above. Entrants may submit 1 entry per unique WOW-A-THON! ticket received. Entries will not be acknowledged or returned. The entry must not contain material that is unlawful or in violation of, or contrary to the laws or regulations in any jurisdiction where entry is created.

Selection of Winning Entries/Winner Notification: Each day during the Sweepstakes Period, twenty-four (24) winners will be selected at random. The selection of the winning entries will be conducted by a third party promotions company, Cataboom LLC. The winning entries will be determined at random by a computer hosted by Cataboom, LLC that uses a proprietary, auditable and verifiable electronic process. Each winner will be notified instantly on the sweepstakes page after completing the entry criteria described above. If you receive a message that contains any message other than a winning prize message, you are not a prize winner.

Prizes:. The entrants selected as the winners will receive one of the following prizes that are listed below. The prize that each winner will receive will be determined at random by a computer using a proprietary, auditable and verifiable electronic process that is hosted by Cataboom, LLC. All prize values are listed in United States Dollars.

As applicable, winners shall be solely responsible for all federal, state, and/or local taxes, and the reporting consequences thereof, and for any other fees or costs associated with the applicable prize.

If the individual winner is unable to accept or use the applicable prize, such winner forfeits the prize in its entirety. The prizes are nontransferable and no substitutions are allowed except by Sponsor, who reserves the right to award a prize of equal or greater value if the prizes described above are unavailable. No prizes can be sold, refunded, commissioned, bartered, exchanged, or redeemed for cash from the Sponsor.

ALL PRIZES ARE AWARDED "AS IS" AND WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED AND SPONSOR HEREBY DISCLAIMS ALL SUCH WARRANTIES (INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE).

Participation:. By participating in this Sweepstakes, all participants agree to be bound by these Official Rules.

Copyright/Publicity Release: By participating in the Sweepstakes, in addition to any other rights which may be granted in any other agreement entered into between Sponsor and any entrant in the Sweepstakes, each entrant (i) irrevocably grants the Sponsor and its respective successors, assigns, and licensees, the right to use such entrant's name, likeness, image, and biographical information in any and all media anywhere in the universe for any purpose in connection with the Sweepstakes or GuestPath®, including, without limitation, advertising and publicity purposes and for publishing on the GuestPath® Facebook page and in Sponsor’s internal publications and (ii) hereby releases the Released Parties (as defined below) from any liability with respect thereto.

General Rules: Sponsor reserves the right to reject and disqualify any submissions that could be offensive or inappropriate or that do not meet the terms and conditions of these Official Rules. If the Sweepstakes is not capable of running as planned for any reason, including but not limited to, infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the reasonable control of Sponsor or Cataboom, LLC which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, Sponsor reserves the right at its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes. If the Sweepstakes is terminated before the end of the Sweepstakes Period, Sponsor will (if possible) select the winner(s) from all eligible entries received as of the date of the event giving rise to the termination. Inclusion in such drawing shall be each entrant’s sole and exclusive remedy under such circumstances. Sponsor is not responsible for lost, late, incomplete, misdirected or illegible entries, or for electronic transmission errors, or for technical malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive entry information by Sponsor. The Sweepstakes and these Official Rules will be governed, construed, and interpreted under the laws of the State of New York without giving effect to any choice of law provisions that would cause the application of the laws of any other jurisdiction. If any provision of these Official Rules is deemed unenforceable, it will be enforced to the extent permissible, and the remainder of these Official Rules will remain in effect.

Sponsor, Cataboom, LLC and any other entities involved in the sponsoring, fulfilling or administration of or supplying the prizes for the Sweepstakes and any of Sponsor’s and such other entities’ respective officers, directors, members or employees (collectively, the “Released Parties”) are not responsible for nor assume any liability for: (a) any incorrect or inaccurate entry information, or for any faulty, failed, garbled or jumbled electronic data transmissions; (b) any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of this Sweepstakes; (c) any miscommunications or for the incorrect or inaccurate capture of information, or the failure to capture any information; (d) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or transmission or communications line failure, regardless of cause, with regard to any equipment, software, systems, networks, lines, satellites, servers, computers or providers; (e) inaccessibility or unavailability of the Internet, including any failure of any electronic entry to be received on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof; or (f) any injury or damage to the entrant’s or to any other person’s computer which may be related to or resulting from any attempt to participate in the Sweepstakes or access or download any materials from the sweepstakes site or the Sponsor’s website. Without limiting the generality of the foregoing, Sponsor is not responsible for incomplete, illegible, misdirected, misprinted, late, lost, damaged or stolen prize notifications.

EACH ENTRANT AGREES TO RELEASE, DEFEND, INDEMNIFY AND HOLD HARMLESS THE RELEASED PARTIES FROM ANY AND ALL LIABILITY FOR CLAIMS, INJURIES, CAUSES OF ACTION, LOSSES OR DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION, WRONGFUL DEATH, PERSONAL INJURY OR INTELLECTUAL PROPERTY INFRINGEMENT, ARISING OUT OF OR RELATED, IN WHOLE OR IN PART, TO PARTICIPATION IN THE SWEEPSTAKES OR ANY SWEEPSTAKES-RELATED ACTIVITY, OR FROM ENTRANT’S POSSESSION, ACCEPTANCE, RECEIPT OR USE/MISUSE OF ANY PRIZE, WHETHER UNDER CONTRACT, TORT OR ANY OTHER LEGAL THEORY, AND, FURTHER AGREES TO INDEMNIFY RELEASED PARTIES AGAINST ANY LIABILITY OR EXPENSE (INCLUDING REASONABLE ATTORNEY’S FEES) ARISING IN CONNECTION WITH THE FOREGOING. RELEASED PARTIES ARE NOT RESPONSIBLE FOR ANY INABILITY OF ANY WINNER TO ACCEPT OR USE ANY PRIZE (OR ANY PORTION THEREOF) FOR ANY REASON.

NOTE: Participation must be by the eligible Delaware North employee, temporary worker or volunteer who was awarded a WOW-A-THON! ticket and only as directed in these Official Rules. Participation by any other individual or any entity, and/or originating at any website or other platform, including but not limited to, commercial promotion subscription notification and/or entering service sites, will be declared invalid and disqualified from this Sweepstakes. The use of any device to automate the entry process is prohibited and will result in automatic disqualification of any such entry.

Winners List: To request any legally required winner’s list, send an email with subject line: "2019 GuestPath Winter WOW-A-THON! Sweepstakes“ to mastory@delawarenorth.com. Names of winners are available after end of the Sweepstakes Period.
